Terms of Service for Swifniq Solutions

Please read these Terms of Service ("Terms") carefully before using any websites, mobile applications, or software tools (the "Service") operated by Swifniq Solutions ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

When you create an account with us for any tool within the Service, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party social media service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

2. Free Trial

The Service may offer a free trial for specific tools, which may be limited in time or features (e.g., specific daily usage limits or limited functionality).

The terms and conditions of the free trial, including its duration and usage limits, will be specified at the time of your sign-up for the free trial.

We reserve the right to modify or discontinue the free trial offer at any time without prior notice.

3. Subscriptions & Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (e.g., monthly or annually), depending on the type of Subscription plan you select when purchasing a Subscription.

At the end of each period, your Subscription will automatically renew under the exact same conditions unless you cancel it or Swifniq Solutions cancels it.

You may cancel your Subscription renewal either through your online account management page or by contacting the Swifniq Solutions support team.

A valid payment method, such as a credit card or PayPal, is required to process the payment for your Subscription. You shall provide Swifniq Solutions with accurate and complete billing information.

Swifniq Solutions reserves the right to modify its Subscription fees at any time. Any Subscription fee change will become effective at the end of the then-current Subscription billing period. We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

4. Content & Acceptable Use

Your Content:

You are responsible for the content of your inputs, conversations, and any other data you submit to the Service. You retain all rights to content you submit.

AI-Generated Content:

The AI responses and content provided by the Service are generated by artificial intelligence. While we strive for accuracy and helpfulness, we do not guarantee the completeness, reliability, or accuracy of any AI-generated content. You should not rely on AI-generated content as professional advice.

AI-generated voice, text, and feedback may occasionally include grammatical, factual, or other errors. Such output should not be considered professional advice or relied upon as an official evaluation. You acknowledge that results are intended solely for learning support, productivity, and self-improvement.

Prohibited Uses:

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate Swifniq Solutions, a Swifniq Solutions employee, another user, or any other person or entity.
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm or offend Swifniq Solutions or users of the Service or expose them to liability.
  • To engage in any activities that could incur excessive costs for Swifniq Solutions (e.g., generating millions of API calls in a short period outside of normal, human interaction patterns).

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Swifniq Solutions and its licensors.

The Service is protected by copyright, trademark, and other laws of both Kenya and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Swifniq Solutions.

6. Educational and Trademark Disclaimer

Our software tools provide practice and utility features that may simulate or reference common formats from well‑known exams, frameworks, or industry standards (e.g., IELTS™, TOEFL®, CEFR, or technical frameworks). **Swifniq Solutions is not affiliated with, endorsed by, sponsored by, or approved by any official testing organization, technical body, or industry standard group.** All trademarks referenced are the property of their respective owners.

Any feedback, estimated scores, or performance analysis provided by the Service are generated by artificial intelligence (AI) and are intended solely for practice and utility purposes. These estimates do not represent official test scores or certified assessments and may contain inaccuracies. You should not present AI‑generated scores or simulated reports as official or certified results from any testing body or professional authority.

7. Disclaimer of Warranty

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Swifniq Solutions makes no representations or warranties of any kind, express or implied, as to the operation of their Service, or the information, content, or materials included therein.

You expressly agree that your use of the Service, its content, and any services or items obtained from us is at your sole risk.

Swifniq Solutions does not warrant that the Service will be uninterrupted, secure, or error‑free; that defects will be corrected; or that the Service or the server that makes it available are free of viruses or other harmful components.

Swifniq Solutions does not warrant the accuracy, reliability, or fitness for purpose of any estimated results, AI‑generated scores, simulated reports, or feedback provided within the Service.

8. Limitation of Liability

In no event shall Swifniq Solutions, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) AI‑generated content, including estimated scores or feedback; and (v) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
